ACCEPTANCE OF TERMS uk
The Dell EMEA trade-in Cash Back Campaign and the Services that Dell provides to you and are subject to the following Terms and Conditions ("T&C´s"). Dell reserves the right to update the T&C´s at any time without notice to you. The most current version of the T&C´s can be reviewed by clicking on the "Terms and Conditions" hypertext link located at the bottom of our landing page.

SERVICES, MEMBER ACCOUNT, PASSWORD, AND SECURITY
The whole description below declared as “Services” describes the cash back process. This process includes:

  1. Provision of the landing page including:
    • a) registration mask to identify claimant’s contact details including e-mail address
    • b) invoice upload functionality
    • c) Settlement Report upload functionality
    • d) FAQ section
    • e) Automated mail service
  2. Verification of the provided invoice scan, settlement report, contact details and the legitimacy of the claim
  3. Dispatch of acknowledgement via e-mail.

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Dell immediately of any unauthorized use of your account or any other breach of security. Dell will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Dell or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.


NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Dell server, or the network(s) connected to any Dell server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Dell server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

DESCRIPTION AND CONDITIONS OF THE OFFER
The Dell EMEA trade-in Cash Back is valid on new purchases made during the promotional period which begins on the 09th of November 2012 and ends on the 31st of January 2013. The promotion is open to businesses whose registered office is located in the UK including Northern Ireland, Channel Islands and Isle of Man, metropolitan France, Germany, Italy, Netherlands, Spain and Sweden. This offer is not open to employees of Dell, their agents, distributors, resellers, dealers, retail staff, retailers, participating stockists or anyone connected with the promotion. Claims can only be submitted by a duly appointed legal representative of the participating business.

Subject:
Eligible customers can claim cash back in the value of 150 EUR / 150 GBP / 1300 SEK per product returned to Dell for recycling through the ARS Recycling Services. To be eligible for this cash back promotion, participating business must have purchased a minimum of 10 qualifying Dell Latitude or Dell XPS mobile products.

Qualifying products are all laptops or tablets of the Dell Latitude and Dell XPS series, equipped with an OEM Windows 8 Licence and and including ARS Recycling Services. Dell reserves the right to expand this offer to other Dell products equipped with Microsoft software licenses and including ARS Recycling Services. A notification will be sent in advance.

In order to be eligible to participate and benefit from the offer, a minimum quantity of 10 (ten) qualifying products must be purchased directly from Dell within the promotional period.
Cash back claims awarded will correspond to the number of products traded-in through ARS Services for recycling, but will in no case exceed the number of new products purchased from Dell.
Customer may choose to trade-in an equivalent or higher number of products for recycling by ARS Services, than the number of new products purchased, but in any case cash back claims awarded will be limited and equivalent to the number of new products purchased and will in no event exceed 50 claims per customer claims.

Limited availability offer:
Cash Back Claims are limited to the first 380 new products purchased for which an old system is traded in and for which the claim registration process has been completed successfully. This is the total number of products available for all of the participating European countries listed above.

To take advantage of the promotion, customers must:

  1. Complete the registration form and accept these Terms and Conditions (T&Cs). Contact, company and email details must be correctly completed at this time in the required fields.
  2. Provide proof of purchase in the form of a scan of the respective invoice, with a clear and unambiguous indication that either an eligible Dell Latitude laptop or a Dell XPS laptop have been billed.
  3. Provide Settlement Report
  4. The promotion is valid on qualifying products purchased directly from Dell within the promotion dates. The promotion is only valid for commercial end user customers; claims for products purchased which will be resold or rented to a third party are ineligible for this promotion.
  5. Once the invoice has been correctly uploaded and submitted, the participant will receive confirmation of the claimed invoice by email from contact@dellcashback.com stating whether or not the claim for cash back has been successful. It is the claimant's responsibility to contact contact@dellcashback.com within seven days of their claim registration if an email acknowledgement has not been received. It is also claimants’ responsibility to verify at that time all the customer contact and banking details necessary to send the cash back, are provided. Dell may require at any time and at its sole discretion complementary evidence that the bank account provided belongs to the business having submitted the invoice, including that bank account details be provided on letter headed paper and sent from an official business e-mail address from the company having purchased the eligible product. Any submission suspected of fraud will be considered void.
  6. The promotion will be paid through a wire transfer to the customer´s bank account. No exception will be made nor will reimbursement be made in any other form or by any other means of payment.
  7. The promotion offer is inclusive of all taxes. Where this promotion constitutes a taxable benefit, all tax liability lies with the recipient.
  8. All instructions form part of these Terms and Conditions. The cash back will only be provided upon satisfaction by the participant of these Terms and Conditions. By completing the claim process participants confirm their acceptance of these Terms and Conditions. Return of one or more qualifying new Dell products to Dell following submission of the claim for the cash back, will disentitle the participant to the claim the offer for the returned new product(s).
  9. In the event of a new purchased product being replaced during the cash back claim period and if the cash back has not been provided, the original claim will be voided and you will need to re-submit your claim accordingly against your replacement order.

  11. The fulfilment of this campaign cannot be granted to the participant who:
    • a. has not purchased the qualifying Dell product(s) within the promotional period; and/or
    • b. has not completed the registration and claim form by the 31st of January 2013; and/or
    • c. has not supplied the scan of the invoice; and/or
    • d. has not correctly completed customer contact and banking details at the time of registration; and/or
    • e. has not submitted his claim online or to the address set out in the claim form within 45 days from the date of purchase; and/or
    • f. failed in any way to comply with these Terms and Conditions.
  12. Dell reserves the right to disqualify incomplete, altered or illegible claims. No responsibility will be accepted for submissions which have been lost, or are late, damaged, misdirected, delayed in the post or insufficiently pre-stamped. Proof of posting will not be accepted as proof of delivery.
  13. Dell is not responsible or liable for any technical, hardware, software, server, website, or other failures or damage of any kind to the extent that this prevents the participant from or otherwise obstructs him/her in participating in the Dell Latitude and Dell XPS promotion.
  14. Dell reserves the right to audit all requests to ensure that the Terms and Conditions of the promotion have been met and to request additional information regarding any and all claims and supporting documents.
  15. Submission of false, incorrect, misleading or fraudulent Dell Latitude and Dell XPS invoices may result in disqualification from this promotion and future Dell promotions and may result in the submitter being subject to prosecution.
  16. The decisions of Dell in respect of any and all aspects of the promotion will be final and binding.
  17. Dell reserves the right to amend or cancel the terms of this offer without notice.
  18. Participants providing an incomplete registration form will be notified. If the participant still fails to comply with the Terms and Conditions, the claim for the cash back will be refused.


PRIVACY AND PROTECTION OF PERSONAL INFORMATION
All personal data collected in the frame of this offer, including email address, will be used for the sole purpose of administrating and executing this promotional offer. This offer is done in accordance with Dell´s Privacy Policy, which can be consulted in the following link: Privacy Policy
